ETHICS AND PRIVACY CODE


DUTIES TOWARDS THE PUBLIC
1. The Spanish Institute will support every measure likely to improve the quality and availability of professional services in the field of language learning and teaching, translation and interpretation.
2. The Spanish Institute will help foster public understanding of the nature and objectives of the services The Spanish Institute offers.

COMMITMENTS

General

The Spanish Institute will:
Promote the Spanish language and culture.
Deliver service excellence.
Provide learning opportunities.
Add educational value.
Treat clients with courtesy and respect.
Demonstrate integrity.
Maintain the highest teaching standards.
Commitment to pedagogical excellence.
Compliance with professional standards and practice.


AVAILABILITY AND DILIGENCE

The Spanish Institute will:
Display reasonable availability and diligence.
Provide a client with all the explanations necessary to the understanding and appreciation of the services rendered.
Not unilaterally terminate a mandate unless The Spanish Institute has sound and reasonable grounds for doing so.



REMUNERATION
The Spanish Institute will promptly inform a client of the scope, terms and conditions of the mandate conferred on, and will obtain the client’s agreement with respect to such scope, terms and conditions.
The Spanish Institute will inform the client of the approximate anticipated cost of its services, except where it may be reasonably assumed that the client has already been so informed.
The Spanish Institute will charge fair and reasonable fees for the professional services rendered

Fees are fair and reasonable if they are warranted in the circumstances and are proportionate to the services rendered.
In particular, The Spanish Institute will take the following factors into account when determining its fees:

1. Qualifications and experience.
2. The time required to execute the mandate.
3. The complexity of the mandate.
4. The scope of the mandate.
5. The liability assumed.
6. The need to perform unusual services or services requiring exceptional competence or speed.

The Spanish Institute will not charge interest on outstanding accounts without first duly notifying its client. The Spanish Institute will charge a reasonable rate of interest on overdue accounts.

PROFESSIONAL SECRECY
The Spanish Institute will respect the secrecy of all confidential information obtained in the practice of its services.
The Spanish Institute may be released from professional secrecy only with the client’s authorization or when so ordered by law.
The Spanish Institute will not have indiscreet conversations about a client or the services rendered to a client.
The Spanish Institute will not make use of confidential information to the detriment of a client or with a view of obtaining, directly or indirectly, a benefit for the Spanish Institute or for another person.
The Spanish Institute will not divulge confidential information received in the performance of their duties.

ACCESSIBILITY OF RECORDS 
The Spanish Institute will respect the client’s right to take cognizance of the documents concerning her/him that are kept in any record created with respect to her/him and to obtain copies of those documents.


PRIVACY POLICY
The Spanish Institute adheres to a privacy policy, in accordance with federal legislation.
The Spanish Institute is committed to respecting the privacy of its customers and recognizing the need for appropriate protection and management of personally identifiable information.
TRADEMARKS
Trademarks and trade-names used by The Spanish Institute of Manitoba are proprietary to The Spanish Institute of Manitoba. Except as may be expressly provided, nothing contained in any materials issued by The Spanish Institute shall be construed as conferring any license or right under copyright or other intellectual property rights.
